Trademark FAQs - related questions & answers

Question: How different does one trademark have to be from another?

Answer:
After an application is filed, the assigned examining attorney will search the USPTO records to determine if a conflict exists between the mark in the application and another mark that is registered or pending in the USPTO.

Question: Can I use a company name and logo if I want to complain about a company?

Answer:
Yes. While trademark law stops the use of someone else's trademark to sell your competing products, it doesn't stop you from using the trademark to refer to the trademark owner or its products.

Question: Does the U.S.Patent & Trademark Office have free searchable online patent databases?

Answer:
Yes, the US Patent & Trademark Office site has full-text and image databases of patents issued since 1790 and patent applications. TIFF software is needed to view the patent images.
